Terms and Conditions (T&C)

I. GENERAL PROVISIONS

1. These regulations define the rules of participation in the Webinars organised by the Polonium Foundation with its seat in Warsaw (Pl. Bankowy 2, 00-095 Warsaw, NIP 701-058-44-08, KRS 0000621890) and a team of volunteers (hereinafter referred to as the Organiser), rules of use from this service, the rules for the protection of personal data of participants and the rules for withdrawal from the contract.

2. The official website of the webinars can be found at: https://poloniumfoundation.org.

3.The administrator of personal data processed in connection with the implementation of the provisions of these regulations is the Polonium Foundation with its registered office in Warsaw (Pl. Bankowy 2, 00-095 Warsaw, NIP 701-058-44-08, KRS 0000621890) and the Webinar Partner listed and marked on the website of a given webinar.

4. The strategic partner of the webinar is the National Science Centre (with its registered office in Krakow at ul. Twardowskiego 16, 30-312 Kraków), NIP: 676 2429638, REGON: 121361537, hereinafter referred to as "NCN" More information at https://www.ncn.gov.pl/en.

5. Cooperation with NCN concerns the organisation of webinars devoted to NCN's offer and informing the Foundation about the status of a strategic partner, direct presentation of the program offer by NCN representatives during the webinar, sending additional information about NCN and its programs to all registered participants of the event.

II. TECHNICAL REQUIREMENTS

1. In order to properly and fully use the webinar, participants should have:

a. a device with access to the Internet (computer, smartphone, tablet);

b. an internet browser: Internet Explorer, Google Chrome, Mozilla Firefox, Opera, Safari, etc .;

c. The use of all the Website's applications may depend on the installation of Java, Java Script, Flash and the acceptance of cookies.

2. To use electronic files, you need appropriate software installed on desktops, laptops, tablets and other mobile devices, including electronic readers. Files with materials related to the subject of the webinar may be in the form of PDF, DOC, XLS files. 

III. INFORMATION ABOUT WEBINARS

1. The official website of the webinars can be found at: https://poloniumfoundation.org.

2. To participate in the webinar, you must register by filling out the appropriate application form available at http://www.poloniumfoundation.org ("Registration").

3. The number of webinar tickets is limited.

4. Confirmation of registration by the Participant means entering into an agreement between the Participant and the Organiser, the subject of which is the provision of a service consisting of access to the webinar, the Participant's possibility of asking questions to the Speaker, and the Organiser sending materials provided by the Partner webinar.

5. Webinars are open to everyone, we encourage the participation of those who, at the time of registration, are: students, PhD students, researchers in academic institutions and the private sector, science innovators and others involved in research activities.

6. To participate in the webinars, participants will have to register before each webinar and will receive a tracking link on the day when they can join the platform.

7. The Organisers reserve the right to change the registration dates. In this case, the information will be published on www.poloniunfoundation.org and on the fanpage on Facebook.

IV. ORGANISER'S OBLIGATIONS

1. The Organiser and Partner of the webinar organise a webinar on a jointly defined topic.

2. The organiser ensures that he will make every effort to guarantee the quality of the webinar in accordance with its description.

3. The Organiser reserves the right to cancel the webinar in the case of random events, e.g. the speaker's illness, cancellation by the speaker. The Organisers reserve the right to change the program for reasons beyond their control. The Organisers will endeavour to postpone or replace the talks if possible.

4. The Organiser reserves the right to change the webinar program, postpone or cancel the webinars and this cannot constitute the basis for submitting financial claims. In such unlikely circumstances, participants will be informed. Participants should check all correspondence from the Organisers to the contact e-mail address provided, including the SPAM box.

5. The Organiser undertakes to enable the Participant who meets the technical conditions to participate in the webinar and to send the webinar materials related to the subject of the organised webinar.

6. Participation in webinars organised by the Organiser is free of charge. Information about these webinars and the conditions of participation in such webinars are published by the Organiser on the website.

V. OBLIGATIONS OF THE PARTICIPANT

1. Participants are required to read these regulations.

2. Providing personal data by the Participant is voluntary but necessary to participate in the webinar.

3. It is forbidden to use the Services by the Participant in a manner that is against the law, decency or violates the legitimate interests of the Organiser.

4. All participants are asked to inform the Organisers of any circumstances that will cause them to need additional help in participating in the webinar. The Organisers reserve the right not to accept any special requests in a safe manner. In this case, the Participant will be notified by e-mail.

5. Participants should behave in a cultural manner and treat other Participants and Organisers with due respect. Offensive language and inappropriate behaviour are prohibited. In case you witness or experience abusive or inappropriate language or behaviour, report to the Webinar Organisers as soon as possible in person or via a private message via social media or email.

6. All Participants must be 18 years or older to participate in the webinars, unless otherwise agreed with the Organisers individually.

7. All Participants are required to provide true and accurate information about themselves in the registration form. Anyone who intentionally breaches this condition can be denied registration and attendance at the webinar. In exceptional cases, if the Participant provided false information in the registration form, the Organisers reserve the right to remove them from the webinar.

8. To register for the webinar service:

a. fill in the registration form available on the Website http://www.poloniumfoundation.org ("Registration"), by providing the e-mail address, name and surname, position and affiliation;

b. accept these regulations and the Privacy Policy;

c. To participate in the webinars, participants will need to register before each webinar and will receive a tracking link on the day they can join the platform;

VI. COMPLAINT

1. Irregularities related to the functioning of the Website may be reported by the Participant in writing or by e-mail: contact@poloniumfoundation.org. In the complaint, the Participant should provide his name and surname, correspondence address, type and date of irregularities related to the functioning of the Website.

2. Complaints must be submitted in writing (or by e-mail) within three (3) days after the webinar. After three (3) days, complaints will no longer be considered.

VII. PROCESSING AND PROTECTION OF PERSONAL DATA

In connection with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (general regulation on data protection, "GDPR"), the Organiser informs that:

1. Upon registration, the Participant agrees to the processing of his personal data by the Organiser as the Data Administrator, on the terms and for the purposes set out in these Regulations.

2. The administrator of personal data is the Polonium Foundation, Pl. Bankowy 2, 00-095 Warsaw, Poland.

3. The administrator has appointed a data protection officer who can be contacted at the following e-mail address: iod@poloniumfoundation.org.

4. The participant agrees to the processing of the following personal data by the Administrator for the purpose indicated in point 5 below the following personal data: name and surname, e-mail address.

5. Personal data referred to in point. 4, will be processed by the Administrator in order to register for the webinar, including the provision of information and communication regarding the Administrator's activities, in particular information and materials regarding the subject and organisation of the webinar, including marketing and advertising information related to the event. After the Participant expresses a separate consent, the Organiser may send to the e-mail address provided by the Participant for the purpose of identification provided during registration.

6. Providing data by the Participant is voluntary, but failure to do so makes it impossible to participate in the webinar. The participant has the right to access their data and correct them. The participant is obliged to update the data provided during registration immediately after the change of this data.

7. Personal data will be processed for the duration of the project, promotional activities and related administrative reports, and after this period for the purposes and to the extent required by law or to protect any claims or until the consent is withdrawn.

8. The recipients of personal data will also be:

a. entities providing and supporting the Administrator's IT systems in order to operate the Website and Mobile Application and entities providing services related to the Administrator's day-to-day operations;

b. an entity providing Typeform server infrastructure based on appropriate personal data processing agreements,

9. Each person, to the extent provided for by law, has the right to access their data and rectify, delete, or limit processing, the right to object to the processing, the right to transfer data, and the right to withdraw consent at any time. Withdrawal of consent does not affect the lawfulness of the processing which was carried out on the basis of consent before its withdrawal.

10. In case of doubts related to the processing of personal data, each person may request information from the Administrator. Notwithstanding the foregoing, each person has the right to lodge a complaint with the supervisory body - the President of the Personal Data Protection Office

VIII. RESPONSIBILITY

1. The Organiser stipulates that the webinars are for informational purposes only and cannot be used as a tool for making any decisions. The webinar materials and their content are only an expression of the views of the authors of individual presentations or a reflection of their knowledge.

2. The Organiser is not responsible:

a. for any damages resulting from the use of the webinar by the Participants in a manner inconsistent with the law or these Regulations.

b. for any damage resulting from the discontinuation of the webinar service if it was the Participant's fault or due to a breach of the law or the Regulations.

c. for any damages arising in connection with the Participant's use of data and information provided as part of the provision of the Webinar service for economic, investment, business purposes, etc.;

IX. PROTECTION OF COPYRIGHT AND OTHER RIGHTS OF INTELLECTUAL PROPERTY AND IMAGE

1. The Organiser, by providing Participants with information disseminated via the webinar, pays close attention to the need to respect intellectual property rights.

2. Names, images and logos identifying the Polonium Foundation and its materials and services are subject to copyright and design rights of the Polonium Foundation.

3. Speakers and presenters declare that:

a. They have intellectual property rights, including the right to share the content presented during the webinar (hereinafter referred to as materials);

b. The materials do not infringe any laws and are not contrary to the law in good manners;

c. They enable the Organiser to record and further distribute the materials by recognising the Organiser - in particular through free transfer of audio, video, photos, biographies of conference presenters;

d. They undertake not to disclose information about Participants, unless the Organiser allows it.

4. Different arrangements as to the scope of the above paragraph require a written agreement with the Organiser.

5. The above provisions also apply to the recording and dissemination of images.

6. The Participant agrees to live transmission, recording and sharing of materials with his participation to other Participants.

7. The Participant grants the Organiser a non-exclusive, free license to use the following fields of use without time and territorial restrictions:

a. recording in any technique (in any system, format and on any medium), including but not limited to digital form;

b. reproduction by any technique (in any system, format and on any medium), including digitally;

c. introducing into computer memory, computer and / or multimedia networks, databases;

d. publicly sharing works and objects of related rights in such a way that everyone can have access to works and objects of related rights at a place and time of their choice (including by making them available on the Internet, e.g. as part of any websites and any paid websites). or free services).

8. The participant agrees for the Organiser to create derivative works and to dispose of and use derivative works. The Participant also allows the Organiser and NCN's strategic partner to exercise the dependent copyright.

9. The participant declares that they agree to the use and dissemination of their image by the Organiser for advertising, promotional and marketing purposes related to the activities of the Organiser and entities cooperating with it. By agreeing to these terms, you agree that if you want to speak during the webinar, you agree that your records will be downloaded and then used by the Organisers for marketing purposes by the Polonium Foundation and selected sponsors and partners, and for advertising in any media related to webinar series. Participants will be able to ask questions indirectly if they do not want their voice to appear on the video.

10. This consent is not limited in time or territory and covers all forms of publication, in particular advertising posters, leaflets, printed promotional materials, TV spots, advertisements in newspapers and magazines and on the Internet, etc.

11. The participant waives all (existing and future) claims, including remuneration, for the use of his image to the extent specified in 6.

X FINAL PROVISIONS

1. Webinars presented on the Website do not constitute an offer within the meaning of the Civil Code.

2. The law applicable to the contract between the Participant and the Organiser and the Webinar Partner, the subject of which are services provided under the conditions set out in these Regulations, is Polish law.

3. Any disputes related to the conclusion or performance of the contract for the provision of the Webinar service will be settled by the competent common courts in Poland competent for the Organiser's seat.

4. In matters not covered by these Regulations, the provisions of Polish law shall apply, in particular the provisions of the Civil Code, the Act of February 4, 1994 on copyright and related rights and the Act of May 30, 2014 on consumer rights and the provisions of the Act on the provision of services. by electronic means

5. A Participant who is a Consumer has the option of using an out-of-court method of dealing with complaints and redress - information on the rules of access to dispute resolution procedures can be found at the following address: http://www.uokik.gov.pl, in the tab "Amicable settlement of consumer disputes. ". The consumer also has the right to use the EU ODR internet platform, used for online dispute resolution, available at: http://ec.europa.eu/consumers/odr/.

6. The Organiser reserves the right to make changes to the Regulations. In matters not covered by these Regulations, the provisions of the Civil Code shall apply.

7. These Terms and Conditions shall enter into force immediately from the date of their publication on the website http://www.poloniumfoundation.org.

8. The changes shall come into force immediately after their publication on the website http://www.poloniumfoundation.org.
